The essay presents Giorgio Agamben’s theory of the paradigm in the first chapter of The Signature of All Things. On Method in order to better understand the well-known use of references to and qoutations from literature in philosophical reasoning and theory. Agamben’s uncommented reference to two short stanzas from Wallace Stevens’ poem “Description without Place”, which he consider the best definition of a paradigmatic ontology, is briefly commented. A gathering of three ‘literary singularities’ from Friedrich Hölderlin/Sophocles, James Joyce, and Samuel (...) _English summary_ This article investigates the impact of moral statistics on suicide in Denmark in the 19. century. Championed as a new European social science, moral statistics was able to reveal statistical regularity on social and moral issues – such as suicide. Statistics proved, firstly, that Denmark experienced one of the highest suicide rates in Europe. Secondly, as demonstrated in 1846 by the Danish physician C. J. Kayser, statistics uncovered that suicides over time occurred regularly in the case of frequency, (...) gender distribution, method of self-killing etc.. This new knowledge encouraged Danish statisticians and physicians to look for societal causes rather than the former theological focus on individual sin. The statistical representations of suicide paved the way for two different interpretations of suicide in the second half of the 19. century, one of which linked suicide rates to the evils of modernisation and secularisation of society, emphasizing drunkenness, alcoholism, and moral decline as causes of suicide. Another, less prevalent, explanation stressed the social and economic inequality of industrialisation as the cause of rising suicide rates. ‘The moral explanation’ prevailed and the official statistical reports as well as newspaper articles was clearly affected by the idea that the rising suicide rates of the 19. century reflected an attack on core values of bourgeois society; moral, sobriety and religion. This way suicide statistics was embedded in a broader social representation reflecting a fear of breakdown of traditional values in modern society. (shrink)

Limiting intensive care is paid increasing attention. In the echoing call for physicians’ ethical self‐restriction, it is easily overlooked, however, that ethics needs a critical epistemological analysis before it can suffice as an emergency brake to futile treatment. This analysis is provided by the present essay. The authors suggest that the difficulties of resolving moral dilemmas related to limiting intensive care may just be due to the unclarified epistemological status of moral claims. Even if normative ethics cannot prescribe right decisions, (...) but only draw conclusions from defined premises, the premises may or may not be true. Their intertwined descriptive and normative evidence is endorsed in an academic and political discourse. There will necessarily be various demands for rationality in prudent decisions between physicians, their patients and society. These demands are formulated dialogically through critical questions and justified answers. A good argument is the convincing one that, finally and ideally, leads to the absence of open objections. Thus, in the end the rightness of a given decision does not depend on axiomatic moral principles, but is comparative and conditional, as it is given in an omnilateral argument. Neither is it the democratic process of shared decision making that we should evaluate, but rather the argumentative state itself, when we judge the morality of health politics and clinical practice. The World Health Organization has declared a world pandemic due to COVID-19. In response, most affected countries have enacted measures involving compulsory confinement and restrictions on free movement, which likely influence citizens' lifestyles. This study investigates changes in health risk behaviors with duration of confinement. An online cross-sectional survey served to collect data about the Spanish adult population regarding health behaviors during the first 3 weeks of confinement. A large sample of participants from all Spanish regions completed the survey. Binomial (...) logistic regressions adjusted for socioeconomic characteristics, body mass index, previous HRBs, and confinement context were conducted to investigate associations between the number of weeks confined and a set of six HRBs. When adjusted, we observed significantly lower odds of experiencing a higher number of HRBs than before confinement overall in a time-dependent fashion: OR 0.63; 95% CI: 0.49–0.81 for the second and OR 0.47; 95% CI: 0.36–0.61 for the third week of confinement. These results were equally consistent in all age and gender subgroup analyses. The present study indicates that changes toward a higher number of HRBs than before confinement, as well as the prevalence of each HRB except screen exposure, decreased during the first 3 weeks of COVID-19 confinement, and thus the Spanish adult population may have adapted to the new situational context by gradually improving their health behaviors. BackgroundDecision-making in out-of-hospital cardiac arrest should ideally include clinical and ethical factors. Little is known about the extent of ethical considerations and their influence on prehospital resuscitation. We aimed to determine the transparency in medical records regarding decision-making in prehospital resuscitation with a specific focus on ethically relevant information and consideration in resuscitation providers’ documentation.MethodsThis was a Danish nationwide retrospective observational study of out-of-hospital cardiac arrests from 2016 through 2018. After an initial screening using broadly defined inclusion criteria, two experienced (...) philosophers performed a qualitative content analysis of the included medical records according to a preliminary codebook. We identified ethically relevant content in free-text fields and categorised the information according to Beauchamp and Childress’ four basic bioethical principles: autonomy, non-maleficence, beneficence, and justice. ResultsOf 16,495 medical records, we identified 759 (4.6%) with potentially relevant information; 710 records (4.3%) contained ethically relevant information, whereas 49 did not. In general, the documentation was vague and unclear. We identified four kinds of ethically relevant information: patients’ wishes and perspectives on life; relatives’ wishes and perspectives on patients’ life; healthcare professionals’ opinions and perspectives on resuscitation; and do-not-resuscitate orders. We identified some “best practice” examples that included all perspectives of decision-making. ConclusionsThere is sparse and unclear evidence on ethically relevant information in the medical records documenting resuscitation after out-of-hospital cardiac arrests. However, the “best practice” examples show that providing sufficient documentation of decision-making is, in fact, feasible. To ensure transparency surrounding prehospital decisions in cardiac arrests, we believe that it is necessary to ensure more systematic documentation of decision-making in prehospital resuscitation. It is argued that the so‐called principles of “strong centering” and “weak centering” central to the traditional Lewis‐Stalnaker semantics for counterfactuals are both fallacious. A foundation for an alternative semantics without these prinsciples is outlined. The core idea is that the statistically normal worlds – rather than those worlds most qualitatively similar to the actual world – should serve as the semantical fulcrum.

Kritika okularo-centrizma naj bi okrepila in dopolnila kritiko logo-centrizma in metafizike navzočnosti. Povedano drugače, ta kritika tvori del kritike razsvetljenske racionalnosti. V članku zagovarjam mnenje, da kritika razsvetljenstva pogosto cilja višje kot pa leži njena tarča. Heideggrova kritika »skopične« racionalnosti naše kulture naj bi služila kot radikalna alternativa okularocentričnemu mišljenju. Pokazati skušam, da Heideggrova kritika razsvetljenske racionalnosti (...) in modernosti ni radikalno antiesencialistična in antifundacionalistična, kot trdijo njegovi učenci. Pokazati tudi skušam, da je Heidegger, zaradi svoje problematične politične preteklosti in kritike modernosti, v najboljšem primeru dvomljiv zaveznik v boju proti zatiralski »skopični« racionalnosti. The initial premise of this paper is that the structure of a proof is inherent in the definition of the proof. Side conditions to deal with the discharging of assumptions means that this does not hold for systems of natural deduction, where proofs are given by monotone inductive definitions. We discuss the idea of using higher order definitions and the notion of a functional closure as a foundation to avoid these problems. In order to focus on structural issues we introduce (...) a more abstract perspective, where a structural proof theory becomes part of a more general theory of functional closures. A notion of proof equations is discussed as a structural classifier and we compare the Russell and Ekman paradoxes to illustrate this. (shrink)

Corporate social responsibility is a complex discipline that not only demands responsible behavior in production processes but also includes the concepts of communicative transparency and dialogue. Stakeholder dialogue is therefore expected to be an integrated part of the CSR strategy :323–338, 2006). However, only few studies have addressed the practice of CSR stakeholder dialogue and the challenges related hereto. This article adopts a postmodern perspective on CSR stakeholder dialogue. Based on a comprehensive single case study on stakeholder dialogue in a (...) global dairy company, we focus on the complexity of CSR dialogue with multiple stakeholders. Drawing on a critical reflexive methodology :1265–1281, 2007), we develop the research question: How is CSR multi-stakeholder dialogue practiced, experienced, and articulated in an empirical context? The purpose is to understand the underlying assumptions, expectations, and principles guiding CSR multi-stakeholder dialogue in an empirical setting, as we focus on how key stakeholders articulate and anticipate the values of stakeholder dialogue and how the actual stakeholder dialogues are enacted. The findings of the study differ significantly from the ideals of transparent and agenda-free stakeholder dialogue. Rather, the study shows an overall tension between ideal and practice, supporting the progressive importance of the dialogue process in itself as an essential part of the end goal. The implication of this is a growing pressure on creating transparency about the positioning and negotiation of roles throughout the dialogue process. (shrink)

The authorship policies of scientific journals often assume that in order to be able to properly place credit and responsibility for the content of a collaborative paper we should be able to distinguish the contributions of the various individuals involved. Hence, many journals have introduced a requirement for author contribution statements aimed at making it easier to place credit and responsibility on individual scientists. We argue that from a purely descriptive point of view the practices of collaborating scientists are at (...) odds with the requirement for author contribution statements. We also argue that from a normative point of view the authorship policies may be unnecessary. Our arguments draw on an examination of 35 years of retraction notices in the journal Science. (shrink)

In contemporary philosophy of science, the consensus view seems to be that scientific explanations describe mechanisms responsible for the phenomena to be explained. Two kinds of explanatory relevance figure in mechanistic accounts of explanation: causal and constitutive. Following prominent accounts, it seems natural to analyze both these relations in terms of systematic interventions into some factor X with respect to another factor Y. However, such interventions are tailored to uncover causal relations only. Construing the constitutive relationship between parts and wholes (...) in terms of interventions thus raises metaphysical, conceptual, and epistemological questions. We here review the barriers that intervention-based inquiry into mechanisms encounters and consider some solutions. (shrink)

In a recent paper Lee Walters criticizes a number of philosophers – including Gundersen – for committing a ‘failure in the argumentative strategy’ when they attempt to amend the standard Lewis semantics for counterfactuals in order to avoid the so‐called principle of Conjunction Conditionalization. In this article we defend a Gundersen‐style probability‐based semantics against Walter's major misgivings: that it is not logically conservative, that it is committed to the Connection Hypothesis, and that it cannot deal satisfactory with irrelevant semi‐factuals.

The paper departs from an analysis of the case of Michelle Dumaresq, a transgender female downhill mountain biker who experienced marginalization within her sport. The analysis is based on Axel Honneth’s theory of recognition. The Dumaresq case is particularly relevant to Honneth’s ideas of solidarity, which provide insight into the dynamics of social integration. Honneth’s theory of recognition also provides a conceptual framework and a methodology that gives new perspectives on the ethical significance of sport. In the paper, an analysis (...) is presented of the lack of solidarity experienced by Dumaresq. The argument is made that sport has a particular potential for realizing solidarity among its practitioners. Realizing solidarity however depends to a large degree upon that the rules of sport are perceived as fair and just. In The Philosophical Quarterly, 48, Alexander Bird raises an objection against the conditional analysis of dispositions: where an ‘antidote’ is present all the supposed conditions for manifestation of a disposition are fulfilled but the manifestation does not occur. But Bird’s argument suffers from equivocation. If we spell out properly whether the disposition's conditions are to include the presence of the antidote or not, the apparent counter‐examples disappear. So his examples do not undermine the conditional analysis of dispositions; they show merely (...) that we need to be careful about describing the examples consistently. (shrink)

Like Kravchenko, we build on Maturana’s bio-logic and the view that language is the “outcome of the evolution of observers.” Yet, Kravchenko offers a narrow “linguistic” reading of Maturana. On our wider view, Kravchenko’s work is criticized for limiting use of “languaging” to aspects of observing that leave out how sensibility and activity inform human practices. In his late ‘A Plea for Excuses’, John L. Austin suggests labelling his philosophy ‘linguistic phenomenology’. This article examines which idea of phenomenology Austin had in mind when he coined this term and what light this sheds on his method. It is argued that the key to answering this question can be found in Merleau-Ponty’s 'Phenomenology of Perception', which Austin must have been familiar with. Merleau-Ponty presents phenomenology in a way Austin could embrace: it is a method, it aims at (...) description and uses reduction, it is a non-idealistic study of essence, and interprets intentionality as ‘operative’. In this light, Austin’s method can be appreciated more fully. (shrink)

Epistemological naturalists reject the demand for a priori justification of empirical knowledge; no such thing is possible. Observation reports, being the foundation of empirical knowledge, are neither justified by other sentences, nor certain; but they may be agreed upon as starting points for inductive reasoning and they function as implicit definitions of predicates used. Making inductive generalisations from observations is a basic habit among humans. We do that without justification, but we have strong intuitions that some inductive generalisations will fail, (...) while for some other we have better hopes. Why? This is the induction problem according to Goodman. He suggested that some predicates are projectible when becoming entrenched in language. This is a step forward, but not entirely correct. Inductions result in universally generalised conditionals and these contain two predicates, one in the antecedent, one in the consequent. Counterexamples to preliminary inductive generalisations can be dismissed by refining the criteria of application for these predicates. This process can be repeated until the criteria for application of the predicate in the antecedent includes the criteria for the predicate in the consequent, in which case no further counterexample is possible. If that is the case we have arrived at a law. Such laws are implicit definitions of theoretical predicates. An accidental generalisation has not this feature, its predicates are unrelated. Laws are said to be necessary, which may be interpreted as ‘“Laws” are necessarily true’. ‘Necessarily true’ is thus a semantic predicate, not a modal operator. In addition, laws, being definitions, are necessarily true in the sense of being necessary assumptions for further use of the predicates implicitly defined by such laws. Induction, when used in science, is thus our way of inventing useful scientific predicates; it is a heuristic, not an inference principle. (shrink)

Hume's regularity theory of causation was partly motivated by a criticism of Descartes' causal account of collisions. According to Descartes, bodies are things with extension, and since having extension does not entail any ability to cause changes of motion in other bodies, such changes must be explained by attributing a ‘causal power’ to bodies, logically independent of their extension. Hume's point is that we can't observe any such causal power and we should not use ideas about such unobserved qualities of (...) bodies. Given his form of empiricism, the regularity theory is the only choice; causation is no more than constant correlation. However, there is a third option beside attributing a metaphysical ‘causal power’ and mere regularity; if we follow Newton and say that bodies are characterised and individuated by their mass, not their extension, we can give another analysis of causal interaction between bodies. It is by having mass a body can cause changes in the motion of other bodies. Thus, using classical mechanics we can give an alternative to Hume's regularity theory of causation in which the necessary connection between cause and effect is understood as a conceptual connection between certain descriptions of cause and effect. It does not satisfy Hume's strictures on concept formation, but no additional metaphysics is necessary. In a sense it is an intermediate position between Humean regularity and an account in terms of metaphysical necessity. (shrink)

A major theme in recent psychoanalytic thinking concerns the use of therapist subjectivity, especially "countertransference," in understanding patients. This thinking converges with and expands developments in qualitative research regarding the use of researcher subjectivity as a tool to understanding, especially but not exclusively in observational and interview-based studies. Psychodynamic or psychoanalytic approaches to research add an emphasis on unconscious motivational processes in both researchers and research participants that impact research experience and data. Building upon Anglo-Saxon and continental traditions, this special (...) issue provides examples of the use of researcher subjectivity, informed by psychoanalytic thinking, in expanding research understanding. In this article I argue for an empiricist view on laws. Some laws are fundamental in the sense that they are the result of inductive generalisations of observed regularities and at the same time in their formulation contain a new theoretical predicate. The inductive generalisations simul- taneously function as implicit definitions of these new predicates. Other laws are either explicit definitions or consequences of other previously established laws. I discuss the laws of classical mechanics, relativity theory and electromagnetism in detail. (...) Laws are necessary, whereas acciden- tal generalisations are not. But necessity here is not a modal concept, but rather interpreted as short for the semantic predicate “... is necessarily true”. Thus no modal logic is needed. The neces- sity attributed to law sentences is in turn interpreted as “necessary condition for the rest of the the- ory”, which is true since fundamental laws are implicit definitions of theoretical predicates use in the theory. This article argues that Kant’s attack on the ars oratoria in §53 of the Critique of the Power of Judgement is directed against eighteenth-century school rhetoric, in particular against the ‘art of speech’ (Redekunst) of Johann Christoph Gottsched. It is pointed out that Kant suggests a revision of Gottsched’s conception of ‘true eloquence’, which was the predominant rhetorical ideal at the time. On this basis, and in response to recent discussions on ‘Kantian rhetoric’, Kant’s own ideal of speech is adressed. (...)
